Texas dental care provider must face whistleblower’s fraud suit

A Texas dentist reasonably alleged that the nonprofit dental service provider Dental Health Programs Inc. and others violated the False Claims Act by falsely promising to adhere to several provisions in federal service provision contracts, a district court ruled.

Whistleblower Sujatha Govindarajan sufficiently alleged that Dental Health, which was funded by Medicaid and federal grants and operates as Community Dental Care, violated the FCA by soliciting payments while deliberately failing to comply with OSHA infection control regulations and contractual provisions, requiring reporting of suspected child abuse and fraud …
